Section 404 Impacts


The U.S. Army Corps of Engineers (USACE) regulates work and structures that are located in, under, or over navigable waters of the United States under Section 10 of the Rivers and Harbors Act of 1899; the discharge of dredged or fill material into waters of the United States under Section 404 of the Clean Water Act; and the transportation of dredged material for the purpose of disposal in the ocean (regulated by the Corps under Section 103 of the Marine Protection, Research and Sanctuaries Act). “Waters of the United States” are navigable waters, tributaries to navigable waters, wetlands adjacent to those waters, and/or isolated wetlands that have a demonstrated interstate commerce connection. The regulatory program tracks permitted impacts and required mitigation in the ORM database: OMBIL (Operations Maintenance Business Information Link) Regulatory Module.

The data available here can be cross-referenced to evaluate the types of actions that have occurred as well as the cumulative impacts. In addition to tracking project impacts, it also contains data on required mitigation. An evaluation of ORM impacts and mitigation data can provide insight into the nation’s status in “no net loss” to aquatic resources. No net loss is a mitigation policy goal aiming to prevent and offset the destruction or degradation of wetlands.

The ORM data was evaluated post-2008 Rule to provide insightinto national trends in the number of impacts, quantity of authorized fill, andauthorized linear impacts.
